    California's SB 216 / SB 1455 Workers' Comp Deadline

    The Clock is Ticking for Solo Contractors

    For decades, solo contractors in California could file an exemption from workers' compensation insurance if they had no employees. With the passage of Senate Bill 216 (and its companion SB 1455), that era is ending.

    What Does SB 216 Actually Say?

    SB 216 mandates that the Contractors State License Board (CSLB) require all active licensees to carry workers' compensation insurance, regardless of whether they have employees. The rollout happens in two phases:

    • Phase 1 (Active Now): Concrete (C-8), HVAC (C-20), Asbestos Abatement (C-22), and Tree Service (D-49) contractors must have workers' comp on file immediately. Roofing (C-39) contractors were already required to carry it.
    • Phase 2 (January 1, 2028): All remaining active CSLB licensees must have workers' comp on file. If you do not provide proof of coverage by this date, your license will be suspended.

    Why Did California Do This?

    The state legislature targeted the underground economy and the misclassification of employees as independent contractors. Too many "solo" contractors were hiring day laborers or paying cash under the table. When those workers got hurt, the burden fell on the state or the property owner. SB 216 levels the playing field so legitimate contractors aren't underbid by those dodging insurance costs.

    What It Means for You

    If you are a true solo operator (no employees, no casual labor, no 1099 helpers), you must still purchase a minimum-premium workers' comp policy by 2028 to keep your license active. If you occasionally hire help, you need it right now.

    Don't wait until December 2027 to scramble for a policy. Carriers will be slammed with applications, and rates may fluctuate. Secure a minimum-premium policy early to establish a clean Experience Modification (X-Mod) history.
